Thank you for your interest in our Apps and Websites. Please read this Terms of Service agreement before accessing or using our Apps and Websites, because it is important you understand the conditions, requirements, and limitations when using our products and services. Our Services, including the AI Assistant feature, are provided for educational and informational purposes only. They do not constitute financial or investment advice.

“Fiduciary,” “Fiduciary Labs,” “We,” “Our,” and “Us” refer to Fiduciary s.r.o., Rybná 716/24, Staré Město, 110 00 Praha 1, Czech Republic, as well as our directors, subsidiaries, contractors, licensors, officers, agents, and employees.

The “Service” or “Services” refer to the applications, websites, software, products, and services provided by Fiduciary.

The “App” or “Apps” refer to the mobile, web, or desktop applications operated by Fiduciary.

The “Website” refers to any website operated by Fiduciary (e.g. sumio.app) and all content, services, and products provided by Fiduciary at or through the Website.

“The User,” “You,” and “Your” refer to the individual person, company, or organization that has visited or is using the Website, App, or Service. A User must be at least 18 years of age.

WHO WE ARE & WHO WE ARE NOT

Fiduciary is a private limited liability company based in Prague, Czech Republic, European Union. We are independent developers. Our mission is to make financial planning and wealth management accessible, affordable, and transparent.

We are not investment advisors, financial advisors, planners, brokers, or agents/dealers. We do not sell any financial products or financial services. Our Service is not meant to be in any way taken as investment advice. We provide our Service for educational and informational purposes only.

AI ASSISTANT DISCLAIMER

The AI Assistant is a tool provided for educational and informational purposes only. It generates summaries and insights based on available data and algorithms. We make no representations or warranties regarding the accuracy or completeness of the information provided by the AI Assistant. Users should not consider the AI Assistant outputs as a substitute for professional financial advice. We accept no liability for any decisions made based on the information provided by the AI Assistant. Always consult with a qualified financial advisor before making investment decisions.

ACCEPTABLE USE POLICY

While using the Service, you must comply with all applicable laws and regulations. You agree not to upload harmful content, attempt to disrupt or tamper with servers, scrape data via automated means, or violate the rights of any third party.

PAID SERVICES & SUBSCRIPTIONS

Our business model is based on paid premium subscriptions. Part of our Service is only available to Users who pay premium subscription fees.

We use the Apple App Store and Google Play Store for the distribution of our Apps and RevenueCat for managing subscriptions. You can manage or cancel your subscription at any time via your Apple App Store or Google Play Store account settings.

ACCOUNTS

You can create an optional Sumio account using your email address for authentication and feature association. We use Google Firebase for secure hosting and verification. You may delete your account at any time within the App, permanently removing your associated data.

DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

Fiduciary provides the Website and the Service “as is” and “as available,” without warranty of any kind. We disclaim all warranties, whether express, implied, or statutory, regarding the Website and the Service including merchantability, fitness for a particular purpose, title, security, and non-infringement.

To the maximum extent permitted by applicable law, Fiduciary shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or any loss of profits or data arising from your use of or inability to use the Service.

GOVERNING LAW

This Agreement and any access to or use of the Website or the Service are governed by the laws of the Czech Republic and the European Union. You and Fiduciary agree to submit to the exclusive jurisdiction and venue of the courts located in Prague, Czech Republic.
